Civil Litigation in California Courts

Contract, property and business disputes in Superior Court, from demand letters through discovery, motions, settlement and trial.

When a dispute cannot be resolved informally, you need an attorney who knows California civil procedure and the local Superior Courts. We represent individuals and small businesses as plaintiffs and defendants in Orange County and Los Angeles County.

Matters we handle

  • Breach of contract and unpaid invoices
  • Landlord and tenant disputes, including security deposits and lease breaches
  • Real property disputes
  • Business and partnership disputes
  • Fraud and misrepresentation claims
  • Defense of lawsuits and cross complaints

The litigation process

  1. Case evaluation of the facts, documents, deadlines and realistic outcomes.
  2. Demand and negotiation before filing, when that is likely to resolve the dispute.
  3. Pleadings, including complaints, answers, demurrers and motions to strike.
  4. Discovery: interrogatories, document requests, requests for admission and depositions.
  5. Motions, including summary judgment and motions to compel.
  6. Mediation and settlement, which resolve most cases.
  7. Trial and post judgment enforcement or appeal.

Been sued?

In most California civil cases you have 30 days after personal service to file a response. A default judgment can be entered against you if you miss that deadline. Contact us promptly so there is time to evaluate your defenses and any cross claims.

Frequently asked questions

How long do I have to file a lawsuit in California?

It depends on the claim. Breach of a written contract is generally four years, an oral contract two years, and many injury and property claims two or three years. Some claims against public entities require a government claim within six months. Get advice early.

Should I try to settle?

Most civil cases settle. A realistic view of the evidence, the cost of litigation, and the chance of collecting a judgment helps decide when and how to negotiate. Mediation is often effective and is encouraged by California courts.
